Tennessee bill targets PBMs’ ownership of pharmacies

NCPA is working closely with the Tennessee Pharmacists Association in support of SB 2040, legislation that would prohibit PBMs from owning pharmacies. To date, NCPA has supported the bill with policy and legal review, two grassroots calls to action, and written comments to the Senate Finance, Ways, and Means Committee. Last week, the committee passed SB 2040 with amendments by a vote of 8-1.

Pharmacist and NCPA member Sen. Bobby Harshbarger is the bill's sponsor; you can see his master class closing argument for the bill here. SB 2040 comes on the heels of groundbreaking legislation last year in Arkansas. Bills with similar provisions are also currently introduced in New York, New Jersey, Pennsylvania, Arizona, Oklahoma, and Vermont. The House version of the Tennessee bill, HB 1959, is scheduled for a subcommittee hearing this week.
