NCPA has been supporting the West Virginia Independent Pharmacy Association on HB 5430, with potentially innovative provisions that would further advance state’s the already-leading work on PBM regulation. One provision addresses spread pricing in a unique way by prohibiting PBMs from charging insurers more than NADAC and disallowing PBMs from using group purchasing organizations as a means to avoid compliance. Additionally, the bill moves oversight of PBMs operating in the Public Employee Insurance Agency marketplace under the Office of the Insurance Commissioner. It mandates that PEIA cannot contract with PBMs who own licensed pharmacies in the state. The bill also addresses Medicaid by requiring the Office of the Insurance Commissioner to conduct biennial cost of dispensing surveys. HB 5430 has cleared the House and is now referred to the Senate Health and Human Resources Committee.
