Virginia PBM bill advances

An amended version of Virginia HB 830 has passed the state's House of Representatives with a unanimous vote. The current version of the bill requires pass-through pricing; prohibits PBMs from reversing and resubmitting claims without notification to the pharmacy; stops retroactive reimbursement adjustments, including by effective rates; and addresses PBM retaliatory behavior.

The bill applies to the state employee health plan and commercial plans not subject to ERISA. There was an unsuccessful amendment effort to add ERISA into the scope of the bill. The bill will now move to the Senate.
