Kevin Duane, owner of Panama Pharmacy and member of the NCPA State Legislation and Regulation Committee, testified in support of Florida SB 1256, legislation addressing predatory audit practices of PBMs. Among its provisions, the bill requires PBMs to apply uniform audit standards, scope, frequency, and penalty practices to all pharmacies within the pharmacy benefit plan's or program's network, including PBM-owned/affiliated pharmacies and non-affiliated pharmacies.
The bill would also prohibit PBMs from imposing stricter audit methodologies, higher error thresholds, expanded documentation requirements, or more frequent audits on non-affiliated pharmacies than on PBM-owned/affiliated pharmacies. The bill limits each audit to a random sampling of no more than 0.1 percent of prescriptions and addresses appeals and recoupments. SB 1256 was voted favorably out of the Senate Banking and Insurance Committee and now moves to the Senate Appropriations Committee on Agriculture, Environment, and General Government.
