Gov. Joe Lombardo (R-Nev.) signed into law SB 389, legislation requiring the state Medicaid program to utilize a single PBM to administer its pharmacy benefit. The law requires the Department of Insurance to issue rules for establishing criteria for selecting the PBM, some of which include reporting requirements, not using spread pricing, and setting reimbursement parameters. Reimbursement parameters include using acquisition cost via NADAC or the option for creating a state-based product reimbursement benchmark. The law does not require dispensing fees based on the state fee-for-service methodology but enables rules to vary dispensing fees based on pharmacy type.
