FTC chair no longer recusing himself from PBM lawsuit

Thursday night, Federal Trade Commission Chair Andrew Ferguson said in a statement that he would no longer recuse himself in a lawsuit against pharmacy benefit managers over insulin pricing practices, clearing the way for the lawsuit to resume. This follows the FTC’s decision earlier in the week to pause the case as the two remaining commission members had both recused themselves from the case. Earlier in March, President Donald Trump fired the two Democratic commissioners at the FTC, after previous Chair Lina Khan’s resignation, leaving Ferguson and the other recused Republican Melissa Holyoak as the only remaining commission members.
