New Mexico H.B. 174, legislation requiring community pharmacies to be reimbursed in the commercial market using NADAC plus a professional dispensing fee based on the state Medicaid fee-for-service program’s cost to dispense, was passed by the Senate Finance Committee after clearing the House by 61-0 vote. Community pharmacies are defined as 1) open to the public for prescriptions to be filled; 2) located in the state or near the state border, if the border is a primary source for Medicaid recipients to receive prescription drugs; and 3) not government-owned; hospital-owned; owned by a corporation that owns hospitals; an extension of a medical practice or special facility; owned by a corporate chain of pharmacies with stores outside of the state; or a mail-order pharmacy. The bill can now move to the full Senate for consideration.
