Members of Congress urge CMS not to allow DIR fees on negotiated drugs

NCPA July 11, 2024

Rep. Raja Krishnamoorthi (D-Ill.) was joined by Reps. Don Davis (D-N.C.) and Vicente Gonzalez (D-Texas) in requesting that the Centers for Medicare & Medicaid Services follow the directives set out by the Inflation Reduction Act (IRA) by requiring pharmacies to be made whole when they dispense drugs in the Medicare Drug Price Negotiation Program. Additionally, Sen. Jon Tester (D-Mont.) sent his own letter to CMS on the issue. NCPA was grateful to have the members clarify what the congressional intent was when the IRA was written and express this to CMS as it finalizes the rulemaking regarding implementation of these maximum fair price drugs. Both letters speak to the effects that additional under-reimbursement would have on independent pharmacies as well as seniors and those in rural areas. We look forward to continuing our work together to make sure independent pharmacies can serve their patients under this new law.
